If I owned a trademark on "Absinthe Games Presents..." and you were like "hey can I make a video called "Absinthe Games Presents A Reaction To This One Dude's Post," I might say that's an infringement. But you could title the video something else if you wanted.

Honestly? I think you're just too invested in the situation, overall, and ready to fight anyone who looks like they think any of this is a good idea.

I think it's pretty much all a terrible idea and they're getting what they deserve, here.

Trademark is only given when there's no objections. Absinthe Games will have an objection if you get trademark to it. Of course, he has 30 days to object. Here's hoping these guys don't get trademark approval for reaction videos. Naming it something else doesn't make sense. A reaction is a reaction. Just because I go around making 1000 videos with title "Kids tasting' or "Elders tasting" doesn't make me the sole owner and trademark holding of Tasting. Just because my channel is named TASTE doesn't give me the right to takedown videos of folks tasting food. You can't hold an emotion or a verb or a trait hostage to copyright and trademark infringement. Good luck putting up videos of folks tasting food, I'm going to trademark it and make millions!!

I'll provide the tools and utinsels and the recipes and the mannerism on how to eat food, and what words to use to describe food. Fuck the food critic industry doing it before me, I did it first okay!



Next up, "Kids drive" and "Elders drive", where I rent various cars and see how well they drive and if they like it dislike it. Then I'll trademark DRIVE and DRIVING, and all you folks putting up driving videos will owe me money!

All your verbs and emotions belong to me! I'm off to own the term trademarking. I'll do videos of Kids Trademarking and Elders Trademarking, and then none of you fucks can trademark shit without paying me!

Next up, BUYING. Anyone putting up videos of purchases owe me that product too!

So what does our format even mean? showing some people a video in front of a camera and then record it? that your title is X react to Y? that the biggest problem, how ambiguous this is, they already screwed some Youtubers before and making an official statement like that, it's only saying that now they have even more power to screw more people.

Their idea of expanding to let's say South America / Europe / etc. with partnerships and all of that is quite cool, no one can deny that but it's not like that's their true goal.

By going with they example, sure Burger King cannot forbid you from making hamburgers, you just cannot do it with 2 slices of bread, some vegetables and meat in between and don't you dare to call it a hamburger.

It will be interesting to see if the sponsors starts pulling out, as that would be a big blow to the channel.

Man I just watched the update video again.

It's just crazy how that video feels. The tone and everything. It's almost indescribably bad.

I think it's like...too rehearsed and scripted? They needed to be on their knees here and they alternate between annoyed and bored.

It's people not understanding what a Trademark actually is. Reading through the thread it's amazing how many people do not understand what the term is and mixing it up with copyright. I'm no business man, but in school we clearly learn what a Trademark, Patent and Copyright is. Coke has a Trademark for their brand, does not mean others can not make drinks like theirs just can not copy their labels and of course ingredients, stuff that makes Coke distinctly Coke, as it can dilute their brand. You own the style of your business that is all. Trademark protects the brand. Funny enough I can trademark a business, and someone can take the name of my business,
but as long as there is no confusion in the eyes of the consumer
, they can not sue you. You can't own react videos it's impossible people, it's not legal, since they never invented it and even if they did it will be difficult to prove, but then we falling under patent laws, which I do not fully understand.

Just a correction for this otherwise good post - you only need to show a LIKELIHOOD of confusion, though actual confusion is one factor. Also, they CAN sue you, they just won't win. Anyone can file a lawsuit. If they have the money, though, they could use the initial court complaint to bully smaller creators, theoretically.

I don't know all the facts, though. Were the videos that were taken down using the "Reacts" brand names? If the mark is descriptive, they could still protect it if they show something called Secondary Meaning, which is proof that the public connects that brand with them as the source. I'll have to dig into their registrations. Otherwise it's odd that something as descriptive as "Kids react to" would make it past the examiner.

Can a mod please change the thread title to "trademark"? It's causing confusion, much like other reaction videos with the Fine Bros' vids

I got this on my first viewing, they seemed so desperate.

The constant eye rolls and audible sighs through out their "explanation" of their tomfuckery is a pretty clear indication. Then there is the body language that might as well say "fuck all of you."

The live counter fascinates me. To think that every five seconds there are half a dozen people sitting at their computers somewhere in the world thinking "Man, fuck these guys" and clicking the unsubscribe button.
