The Manhattan DA’s office won’t press charges against one of the motorcycle thugs believed to have terrorized a driver and his family after a wild chase on the West Side Highway, and argued against prosecuting a second biker before ultimately agreeing to, sources said Wednesday.

“F—!” the biker who was charged, Christopher Cruz, 28, of Passaic, NJ, said when he was swarmed by media as he left Manhattan Criminal Court on $1,500 cash bail, charged with reckless driving and unlawful imprisonment.

Bikers got off lucky really. If I had been behind the wheel of an SUV and they started pelting my car like that with my family in it I'd have side checked them into the asphalt.

Down here when someone does something stupid like the bikers in the video, we'd usually say "Are you crazy bro? That's how people get shot."

Yup. My old man keeps a Glock 9mm loaded w/ hollow points in his center console. He's not a hothead, not a Billy-Badass, and that gun has never come out of said console, but if someone was beating on his window with a helmet w/ my mom in the car they'd get double-tapped.

The fact you don't even need concealed carry to keep a firearm in your car is another thing that tempers my road rage.

This is a terrible story, but I've driven the New York streets and if they really did chase him 50 blocks as was implied, I am unsurprised at how this ended.

I hope they have a good attorney because the civil suit is going to be on its way, it is going to last a long time and cost this family a fortune, possibly everything.

The way this post is written misrepresents the story here, I think.

Christopher Cruz is the guy who brake-checked the RR before it took off. He is being charged, although apparently the prosecutors had to be convinced to do it.

The guy not being charged is Allen Edwards, and this is what the prosecutors have to say about it: “Prematurely charging individuals with low-level crimes does not further the goals of the investigation, and could weaken the cases we expect to bring against the perpetrators of serious crimes.”

Let's get things straight here.

I'm 100% on the SUV drivers side but this is just how the system always works. The motorcyle driver couldn't be in a worse position, no license etc. He should/probably will lose, but he will sue and even having an attorney it will cost the family a lot.

ooh i don't think the system is thaaat bad. This isn't china or something. And the case is already as hot as it is, gonna be interesting to see which attorney and judge combo could lead to that... but hey anything is possible in the land of the free.

No pun intended but he really doesn't have a leg to stand on. Doubt he has the funds to finance and then ultimately lose the case.

Contingency. There's a lot of lawyers out there to proceed with that alone, especially given this has made national headlines.

As Homeboyd stated correctly, the attorney will work on a contingency basis. There are several fields in the law where lawyers just work on a contingency fee. Personal Injury and Employment Law are one of the big areas. The reason for this is because the attorney is taking a big risk in bringing these sorts of cases into court, which makes them think if a case is worth their time and effort. Thus, it eliminates attorneys bringing frivolous cases into our court system. An attorney may grab this case because (a) he wants to get his name in the papers and build some of sort of business or (b) just get a quick settlement out of the Ranger Rover's auto insurance policy. I don't think many lawyers will want to take this case due to the fact that it is a sh*t case. First, the injured biker wasn't even supposed to be driving a motorcycle since he never had a valid motorcycle license. Meaning he would not have been in that situation, but for his disregard of motor vehicle laws. Also,from what is being perceived from the media, the plaintiff wouldn't be that sympathetic compared to the would be defendant, the Range Rover driver, who was trying to protect his family from a mob of bikers. Ultimately, the media will be used as a tool to give some sort of idea on how a jury may see this, but the jury is also known as a "black box" because you have no idea how they will come out.

Especially if you look at the facebook page made to support the injured biker. The facebook page is asking for justice cause he got ran over. I definitely think they'll have legal troubles coming.

Looking at all those photos of the bikers beating the crap out of the car and dragging the person out of the SUV and beating them bleeding and really left for dead, I feel no sympathy for the biker that was ran over.

Really make me feel nervous when I'm driving and I see a whole bunch of motorcycle in a group driving in and out of traffic recklessly.

The driver and his wife sound like they are pretty successful people. Im pretty sure they are going to get some good lawyers (which they probably already have) and arnt going to lose on this one.
 
Are people really defending the bikers? I'd drive over every single of those 300 bikers and not give a single fuck if it means I get the fuck away from them and protect my family.

Harley groups do the exact same fucking thing everyone is crying about, slow down traffic, block intersections, act like total dicks to any cars that try and merge in the middle of their group. They just don't pop wheelies because they cant.

Eh, must be regional, because every Harley rider I see is a blue collar, salt-of-the-earth sweetheart. That said, I fucking hate Harleys.
