All leaked devices so far lacked the actual operating system. I honestly doubt anyone can crack a protection that isn't even completely in place. Keep in mind customer service reps know less about these things than we do. I'm speaking from experience, I worked at Nintendo as a Gameplay Counselor when the Virtual Boy came out: we were given information about the Virtual Boy three weeks before its release, we were able to buy the systems two weeks before release.
