Well, the prosecution has to have hours of what could be used as evidence showing neglect. So if they don't go to jail then it's hard to see why there'd even be a maximum sentence on child neglect given how much proof there is to show in this case. I'd even expect them (the dad and mom) to be looking for a plea deal that would likely just give them probation and counseling, but there's no reason for the prosecution to agree to it given just how much evidence there is.
